I think it is more a Gartley, triggered in this current candle. The pattern drawn like this doesn't fit well at B point, but if it starts seven candles later, at the next high, B point fits better for a Gartley. I like your idea anyway ;-)
this is a valid bat. B point exceed 0.5 but does not touch 0.618 . a gartley must touch 0.618

So it's not valid?

I think that it depends on how are your rules to consider a pattern valid or not. As tntsunrise said, B point doesn't touch next fibo, but if I follow my rules, the candles that cross the fibo level in B can't close beyond that level, so... for me is not valid like this, but you have to mesure how much important is each rule in your trading way... as I said before, I'm more into the gartley in this case, besides there was a rsi divergence...
For me as long as it doesn't touch a fibo level , I don't considere it . Here 61.8 is not reached so I'm looking for a bat.
On the 15min chart there is a divergence on the RSI, but not on the hourly chart. I think there should stll be a new higher high and 88.6 fibo level should be reached. Let's see what will happen.
I agree, it should continue upwards.

As for the problem of a given level being touched or not, I find it useful to compare the data from two providers: I had a case, in which my broker (OANDA) showed a level not touched, whereas the FXCM's chart was saying "touched". :-) While I was adamantly not accepting the level to be reached, faced with the fact from an alternative broker, I had to concede the the level's test actual had taken place. So, with that experience in mind, I always give more room to the exact levels' actual tests and call them done a pip or two away. Surgeon-like precision is more useful in position-sizing.
